- Code of conduct for preventing and combating harassment at work (hereafter Code of Conduct_Harassment)

-  Legal framework of harassment in Labour Code and other applicable legislation

 

Any INESC TEC collaborator or third party who considers that they are the victim of harassment within the scope of their activity at INESC TEC, or in their interaction with INESC TEC, may submit a report of harassment.

Any person who is aware of situations and behaviours practised by INESC TEC collaborators that may indicate situations of harassment may also submit a report.

Person Responsible for receiving and following up on Reports: Independent Commission, appointed for that purpose, currently Susana Rodrigues e Tiago Rebelo Ramalho.

 

Response deadlines:

  • within 7 days from the date of receipt of the Report: notify the complainant of the receipt and information on the possibility of submitting a complaint to the Authority for Working Conditions or the General Inspectorate of Finance.
  • Within 30 days from the date of receipt of the Report: to communicate the measures planned or adopted to follow up on the Report.

 

Record Keeping of all records of any analysis or investigation of a report of harassment, for a period 5 years, from the termination of relationship between INESC TEC and the person concerned in the report, except when they constitute evidence of legal action, case in which it must be kept until the final judgment, and unless longer retention period is required by law.

 

Follow-up to the Report: If the investigation proceeds, the procedures set out in the Code of Conduct_Harassment and the Labor Code apply, as far as the disciplinary procedure is concerned.

 

Anonymous reports: The notification of receipt of an anonymous report and communication to the complainant of the measures planned or adopted, follow the same deadlines as identified complaints. However, it can only be consulted, and the Report can only be followed-up by entering the unique report number generated at the time of submission into the platform. This ensures that the identity of the complainant is not known to those who receive and follow up the Report.
